Exhibition Terms and Conditions

This Exhibition Contract (the “Contract”) is entered into between FineArt.gy (the “Gallery”) and the participating artist (the “Artist”) for the purpose of exhibiting artwork at the “Beyond the Brush” art exhibition to be held at the Arthur Chung Convention Centre (the “Venue”).

 

Artwork Submission:

  1. a. The Artist agrees to submit artwork for the exhibition based on their own selection and judgment. Each piece will be commissioned on its own merit, and no preference will be given to any specific medium or piece.

Commission:

  1. a. The Gallery will commission 15% of the profit from sale of each artwork exhibited or sold due to the exhibition. The commission will be deducted from the final sale price of the artwork.

The Artist agrees to remit the 15% commission on the sale of each artwork to the Gallery within [14 business days] of receiving payment for the artwork sold.

  1. The Artist shall provide the Gallery with accurate and timely documentation of the sales made, including but not limited to the date of each transaction.
  2. The Gallery reserves the right to verify the accuracy of the commission payment by requesting additional supporting documents from the Artist, such as sales receipts or bank statements.
  3. In the event that the Artist fails to remit the agreed-upon commission within the specified timeframe or provides false information regarding the sales made, the Gallery reserves the right to take appropriate legal action to recover the unpaid commission and any associated costs.

Safety and Security:

  1. The Gallery will take reasonable safety measures to secure the artwork while on display at the Venue. However, the Gallery will not be liable for any damages or losses resulting from the negligence of the Artist, patrons, or any third parties during the event or thereafter.
  2. The Artist is responsible for ensuring that the artwork is securely framed, wired, and ready for exhibition.

Ownership and Sales:

  1. The Artist retains full ownership and copyright of their artwork throughout the exhibition.
  2. The Artist reserves the right to decide who may purchase their artwork exhibited at the event.
  1.  The Gallery will provide the Artist with a sales report, detailing the artwork sold and the corresponding sales amount, along with the commission deduction.

Promotion and Marketing:

  1. The Gallery reserves the right to use images of the exhibited artwork for promotional purposes, including but not limited to online and offline marketing materials, social media, and press releases.
  1. b. The Artist grants the Gallery the non-exclusive right to reproduce images of their artwork solely for the purpose of promoting the exhibition.

Duration and Termination:

  1. The duration of the exhibition will be specified in a separate agreement or communicated by the Gallery.
  1. b. Either party may terminate this Contract by providing written notice to the other party. In the event of termination, the Artist shall promptly remove their artwork from the exhibition.
  2. Dispute Resolution:
  1. In the event of any dispute or disagreement arising from this Contract, both parties agree that arbitration shall be the mode of resolution. The arbitrator shall be mutually selected by both the Gallery and the Artist.
  2. The decision of the arbitrator shall be final and binding on both parties, and any resulting costs or expenses shall be shared equally, unless otherwise determined by the arbitrator.
